免签或持落地签能否在印尼开展工作

Matters pertaining to working in Indonesia with tourist visa or on-arrival visa

印尼政府自2005年8月起对中国公民提供落地签服务,目前落地签收费35美金,有效期30天,可到移民局再延长30天。根据印尼司法人权部2010年第12号条令,通过落地签证入境的公民,来印尼目的只能是如下情况: Indonesia government had started to offer on-arrival visa services for China citizen since August 2005, where the visa cost 35 USD with a validation period of 30 days, which could be extended for a further 30 days at the immigration department. According to the Indonesian KEMENKUMHAM Act No.12 2010, only visitors for the following purpose can enter into Indonesia with on-arrival visa:

  1. 旅游Tourism
  2. 社会文化访问Social and cultural visit
  3. 商务访问Business visit
  4. 不会对安全产生干扰且能够实现互利共赢的政府公务Government affairs that would not interfere with local safety and can achieve mutual benefit.

需要特别注意的 Things to take note of:

  1. 根据印尼移民法规选择适合的签证入境,入境后不得从事与签证不符的工作。Choosing the appropriate entry method based on Indonesia Immigration Department, and prohibited from engaging in task that does not match with the visa used.
  2. 根据印尼移民法规定,印尼移民官员有权要求出示机票、酒店订单等辅助材料,并有权根据此前签证记录及出入境记录判断是否同意通过免签或落地签方式入境。Based on the Indonesia Immigration Act, Indonesia immigration officers have the rights to request the tourist to display his air tickets, hotel bookings and other supplementary materials, as well as based on the tourist’s previous visa records and entry/exit records to determine whether to grant him visa-free entry or on-arrival visa entry.
  3. 根据印尼移民法规定,免签或落地签均不可用于经商或工作,如从事与签证不符的工作将被处以最高5年有期徒刑和最高5亿印尼盾(约合25万人民币)罚款。According to the Indonesia Immigration Act, tourist holding visa-free or on-arrival visa is not allowed to carry out business or work, and can be penalized with maximum 5 years imprisonment and up to 500 million rupiah (around 250,000 CNY).
  4. 外国人在印尼出门时务必携带护照;如护照在移民局办理延期或丢失也请携带相关证明文件以备检查。 Foreigners should carry his passport with him at all times; if the passport is submitted to the immigration department for extension application or lost, relevant supporting documents should be furnish upon request for inspection.

办理工作签证的流程、需要提交的文件、周期和费用

Procedure, documents required, application period and cost for the application of work permit

1)外籍工人工作证的办理流程为:雇主需要向印尼人力资源部提交外籍工人就业计划RPTKA并获得批准,获得批准后通过人力部的就业指导与扩展就业的网站提交外籍人员就业证的申请,申请通过后得到外籍工作证IMTA。 The application process for foreign labor work permit is as follows: Project owner is required to submit the Expatriate Placement Plan (RPTKA) to DEPNAKER. After obtaining approval from DEPNAKER, the project owner can submit the application for foreign labor work permit via its online portal, and will obtain the temporary Expatriate Work Permit (IMTA) upon approval. 申请RPTKA需要提交的资料包括:Documents to be submitted for the application of RRTKA include:

  • 雇主的姓名和在印尼的地址;Employer’s name and living address in Indonesia;
  • 聘用人员的姓名和地址;Applicant’s name and living address;
  • 项目合同;Project contract;
  • 简述拟聘用人员就任的职位、聘期、工资及其它福利;Short description of the applicant’s position, work duration, salary and other work benefits;
  • 雇主拟议或执行中的培训印尼人未来胜任该职位的计划;Training program planned by the employer for the applicant (for future promotion);
  • 有关部门的介绍信。Recommendation letter from relevant department

雇佣外籍工人的公司需要每月向印尼人力资源部缴纳100美元/每人的外籍员工赔偿基金。The company that employed foreign labor is required to pay 100 USD/person/month to KEMENNAKER.

2)在印尼一些特殊工种如电焊工、电工等比较紧缺,需要从中国引进。目前外籍工人同本地工人配比的方式为技术工人1:10。 It can be noted that some special operation personnel, such as welders and electrician faces shortages in Indonesia, and must be imported from China. Currently, it is understood that the ratio for foreign labor to local labor is 1:10 for technical personnel.

3)外籍人员工作证限定外籍人员的工作地点,可申请多个工作地点,如在工作证指定的地点之外工作将被视为非法。 The foreign labor work permit restricts the work place of the foreign labor, however application for multiple work places is allowed during the application process. Any work conducted outside of the designated work places is considered to be illegal.

4)获得工作证的外籍人员在进入印尼后7日内还需要申请临时居留签证VITAS,有两种方式申请临时居留证,一种是雇主通过印尼移民局提交申请,另一种是外籍人员通过印尼大使馆提交申请办理。Foreigners whom had obtained the work permit must also apply for the temporary residence visa (VITAS) within 7 days of entering into Indonesia. There are two methods for applying the VITAS: a) The employee submit an application to the Indonesia Immigration Department; or b) The foreigner submits an application to the Embassy of the Republic of Indonesia.

5)外籍人员工作证的办理时间通常为2-3个月,费用约为每人每次6000人民币,加急办理需增加费用。临时居留签证费为每人每次40美元。The application period for the foreign labor work permit is typically around 2 to 3 months, and the application fee is around 6000

外籍人员不能在印尼从事的工作

Work that are prohibited to be undertake by foreign labor

根据人力资源部的规定No. 40/2012,外籍员工不得担任以下职位:

人事主管、工业关系部经理、人力资源经理、人力发展主管、人力招聘主管、人员安置主管、人员职业发展主管、人员申报管理、首席执行官、人员与职业专家、人员专家、人员职业发展顾问、工作顾问、工作顾问与辅导、工作培训管理员、工作面试员、工作分析、职业安全专家。

According to the KEMENNAKER Act No.40/2012, foreign labors are prohibited from holding the following positions in Indonesia: HR supervisor, industrial relationship manager, HR manager, HR development manager, HR hiring manager, personnel placement manager, personnel occupational development consultant, job consultant, job consultant and counselor, job training administrator, job interviewer, job analysis, occupational safety specialist.

政府部门在项目所在地对外籍人员的管理

Government management requirements towards foreign personnel on-site

在项目中工作的所有外籍人员须到项目所在地人力资源办公室进行登记。 All foreign personnel on-site (for this project) should be registered with the KEMENNAKER at project site.

工资和薪酬Wages and salary

雇主必须遵守每个省份地方政府制定的最低工资标准。例如,在雅加达,2016年的最低工资标准为每月3,100,000印尼盾(约合人民币1650元)。东南苏拉威西省2016年最低工资标准为每月1,850,000印尼盾(约合人民币930元)。

Employers must comply with the minimum wage standard set by the provincial government. For example, in 2016, the minimum monthly wage standard in Jakarta is set to be around 3,100,000 IDR (or around 1,650 CNY), while the minimum monthly wage standard in Southeast Sulawesi Province is set to be around 1,850,000 IDR (or around 930 CNY) for the same period.

员工保险和纳税义务

Employee’s Insurance and Tax Obligations

公司需要为本地员工缴纳养老保险和医疗保险。外籍工人需要购买意外保险。 The company is required to provide pension fund and medical insurance for all of its local stuff. Accident insurance coverage is required for foreign workers.

外籍人员在印尼工作须按照印尼本地人员的纳税义务缴纳个人所得税。个人所得税(按出国人员在当地收入申报,即使中方员工工资在中国发放当地税务局也会要求企业按一个税率缴纳个人所得税)。 Foreigners working in Indonesia are obligated to pay personnel income tax in accordance to the Indonesia taxation law (based on the reported wages of the foreigner received in Indonesia, even if the salary is received in his country of origin).
